What does Packaging Fee mean?

Packaging Fee is a fee charged by a talent agency when it assembles multiple clients — typically a combination of writer, director, and leading actors — into a single package deal for a film or television project, and then negotiates with studios or networks on behalf of the entire package rather than individual clients. Packaging fees are typically structured as a percentage of a production’s budget and a percentage of profits, and are paid by the production company rather than by the individual talent. Packaging fees have been a major source of controversy in the entertainment industry and were the subject of a significant dispute between SAG-AFTRA and the major talent agencies.

Example:The talent agency packaged the television drama by attaching its own clients as writer, showrunner, and two of the lead actors — then negotiating a packaging fee with the network that compensated the agency directly from the production budget rather than through individual client commissions.
Example: The actor’s business manager explained that on packaged productions, the talent agency typically waived its individual commission in favor of the packaging fee — a structure that sometimes aligned and sometimes conflicted with the individual performer’s financial interests.

The controversy over packaging fees led to a landmark dispute between SAG-AFTRA and the major talent agencies — particularly WME, CAA, and UTA — that resulted in SAG-AFTRA members firing their agents en masse in 2019 in protest of what the union characterized as a conflict of interest. The union argued that packaging fees gave agencies a financial stake in productions that conflicted with their duty to negotiate on behalf of individual clients. A settlement was not reached until 2022, fundamentally changing how packaging is structured and disclosed in the industry.
