Taft-Hartley

What does Taft-Hartley mean?

Taft-Hartley refers to a provision of the Labor Management Relations Act of 1947 that allows a non-union performer to work on a SAG-AFTRA union production once without being required to immediately join the union. When a production hires a non-union performer for a union project, they file a Taft-Hartley report with SAG-AFTRA explaining why a union performer was not cast instead. The performer then has 30 days to join the union or complete their non-union work window. After receiving Taft-Hartley status, the performer may work on one additional union production before being required to join — after which they become ‘must join.’

Example:The commercial production filed a Taft-Hartley for the child actor because they could not find a union performer who fit the specific physical requirements of the role — the report allowed her to work on the union production without requiring immediate SAG-AFTRA membership.
Example: The agent explained the Taft-Hartley process to the family: this was their daughter’s first union experience, she would have 30 days after the shoot to decide about joining SAG-AFTRA, and if she worked on another union production before joining, she would be required to join before filming began.

The Taft-Hartley Act was passed during the post-World War II labor movement period as part of a broader effort to limit union power. Its application to the entertainment industry — allowing non-union performers to work once on union productions — was not the law’s primary purpose but has become one of its most practically significant provisions for the acting community. For child performers in particular, the Taft-Hartley pathway is often how they book their first major union work and build toward SAG-AFTRA membership.
