Contract Negotiation

What does Contract Negotiation mean?

Contract Negotiation is the process by which a performer, their agent, manager, and entertainment attorney work with a studio, network, production company, or other hiring party to agree on the terms of employment — including fee, credit, billing, likeness rights, scheduling, and other conditions before a final agreement is executed. Effective contract negotiation requires knowledge of industry standards, comparable deals, and the specific leverage each party brings to the table. For child performers, contract negotiation should always involve an entertainment attorney reviewing final terms before signing.

Example:The agent opened contract negotiation for the child actor’s series regular role by submitting an initial ask above market rate — a standard opening position that gave room to reach a final number both parties could accept while still protecting the client’s minimum requirements.
Example: The entertainment attorney flagged three provisions during contract negotiation that required revision before her client could sign — the likeness rights clause was too broad, the credit position was below what the role warranted, and the Coogan Law compliance language was absent.

Did you know?
Contract negotiation in entertainment is governed by both legal principles and industry customs that are not always codified anywhere. Knowing what is standard practice — what credits a given role type typically commands, what rates comparable performers have received, which provisions are genuinely negotiable versus boilerplate — is the core expertise that experienced agents and entertainment attorneys bring to the table. For families without this knowledge, every contract negotiation is at a disadvantage.
